1. Welcome to Niuspat
Niuspat is a place to publish, share and discover spoken ideas.
These Terms of Service explain the rules for using Niuspat. By creating an account or using features that require acceptance of these Terms, you agree to them. If you do not agree, you must not use those features.
Niuspat is intended to encourage thoughtful conversation in a safe, respectful and lawful environment.
2. Eligibility
You must be at least 18 years old to create an account or publish content on Niuspat.
By creating an account, you confirm that you are 18 or over. Niuspat is not intended for children.
3. Using Niuspat
You may use Niuspat only for lawful purposes and in accordance with these Terms and our Community Guidelines.
You agree not to:
- Interfere with the operation, security or integrity of Niuspat.
- Attempt to access accounts, data or systems without authorisation.
- Use automated tools to abuse, overload or disrupt the service.
- Upload malicious software or harmful code.
- Impersonate another person or mislead others about your identity or affiliation.
- Use Niuspat to commit, facilitate or promote unlawful activity.
- Circumvent technical restrictions or access controls.
We may develop, change, suspend or discontinue features as Niuspat evolves. Where a change materially affects users' rights or our obligations, we will provide notice where appropriate or required by law.
4. Chambers and Audiopods
A Chamber is a space organised around a subject, interest, group or conversation.
An Audiopod is an individual piece of audio that belongs to a Chamber.
You are responsible for the content you create, the permissions you grant to other contributors, and the links you share.
At launch, Chambers and Audiopods are shared through direct links rather than being publicly discoverable through a general public directory. Their availability depends on their publication status and the features Niuspat provides.
Sharing links and access
Unlisted does not mean private or confidential.
An Unlisted Chamber or Audiopod can be accessed by people who have its direct link, subject to any access controls that are actually in place.
If you share a link, you should assume that the recipient may forward or copy it to other people, who may pass it on again. You cannot reliably control who ultimately receives or opens a link once it has been shared.
You are responsible for considering the intended audience before sharing a link. Do not use an Unlisted Chamber or Audiopod to store or distribute material that requires strict confidentiality.
Niuspat does not guarantee that a link will remain within the group with whom you originally shared it. Changing or deleting content may not remove copies, recordings or information that other people have already obtained.
Publication status
Niuspat may provide different publication statuses as its features develop. At launch:
- Draft: Intended to remain accessible only to its creator.
- Unlisted: Accessible to people with the direct link.
If Public publishing is introduced, content marked Public may be accessible to everyone and may be discoverable through public areas of Niuspat.
You are responsible for checking the publication status of your content before sharing it. Access may also be restricted by Niuspat for safety, moderation, technical or legal reasons.
5. Your content and ownership
You retain ownership of the content you create and publish on Niuspat.
By uploading or publishing an Audiopod or other content, you grant Niuspat a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit and display that content as reasonably necessary to operate, maintain, secure and provide the service.
This licence also allows Niuspat to identify and present content within its features, such as displaying an Audiopod within its Chamber or providing a shareable link. It includes technical processing and temporary copies required to operate the service.
The licence does not transfer ownership of your content to Niuspat. We will not sell your content as our own. Any use of your content for a separate purpose beyond operating or promoting Niuspat will require an appropriate legal basis or permission where required by law.
The licence generally ends when you delete the content or your account, except to the extent that continued processing is necessary for legitimate technical purposes, security, legal obligations, dispute resolution or temporary backup retention. Copies retained by other people are outside Niuspat's control.
You are responsible for ensuring that:
- Your content is your own or you have all necessary permissions to publish it.
- Your content does not infringe copyright, trademarks, privacy rights, image rights or other rights belonging to others.
- You have any consent required to record or publish another person's voice or personal information.
- Your content complies with these Terms, our Community Guidelines and applicable law.
- You do not disclose confidential or sensitive information without an appropriate right or permission to do so.
6. Community standards
Niuspat encourages thoughtful conversation and constructive disagreement. You may challenge ideas and express opinions, but you must not use the service to abuse or harm others.
You must not publish, upload or promote content that involves:
- Harassment, bullying, threats or personal attacks.
- Hate speech or unlawful discrimination.
- Explicit sexual content prohibited by our policies.
- Spam, scams, impersonation or deceptive activity.
- Misinformation deliberately intended to deceive or cause harm.
- Infringement of intellectual property, privacy or other rights.
- Illegal content, including child sexual abuse material, unlawful terrorist content, fraud, intimate-image abuse, credible threats of violence or material facilitating unlawful activity.
This list is not exhaustive. We may publish further rules in our Community Guidelines and Safety information.
Disagreement is welcome. Personal abuse is not.
7. Moderation and enforcement
Niuspat aims to protect users and maintain a lawful, respectful environment.
We reserve the right to review reports and investigate suspected violations of these Terms, our Community Guidelines or applicable law.
Where we consider it reasonably necessary, we may:
- Temporarily hide, block or restrict access to a Chamber, Audiopod or other content while a report or suspected violation is investigated.
- Remove content that violates our rules or applicable law.
- Restrict access to features or suspend or terminate accounts.
- Take steps to protect users, preserve relevant records or prevent further harm.
- Refer matters to, or cooperate with, law enforcement or other competent authorities where appropriate or legally required.
A report does not automatically mean that a violation has occurred. We may take temporary protective measures while the facts are assessed. Following a review, we may restore access, maintain a restriction or take further action.
We will seek to act reasonably and proportionately, taking account of the circumstances, the seriousness of the concern and our legal obligations.
Where appropriate, we will explain significant moderation decisions and provide a way to appeal them.
8. Illegal content, reports and appeals
Users can report suspected illegal content or other concerns through the reporting options provided by Niuspat, including the Safety page. Where available, signed-in users may also report content directly from an Audiopod.
We will assess reports and take appropriate action in accordance with our policies and applicable law. We may prioritise urgent reports involving serious risks, including child sexual abuse material or terrorism-related content.
Where we become aware of illegal content, we will take the action required by applicable law and our legal obligations.
If we remove or restrict your content, or suspend or terminate your account, and you believe we have acted incorrectly or contrary to these Terms, you may appeal through the Safety page or the appeal process we make available.
We will consider appeals in good faith. Where applicable law gives you additional rights to complain or bring a claim, these Terms do not remove those rights.
9. Privacy and personal information
Your use of Niuspat is also governed by our Privacy Policy, which explains how we collect, use, store and protect personal information.
You should read the Privacy Policy before using the service. It also explains important considerations when sharing Chamber and Audiopod links.
10. Niuspat's intellectual property
The Niuspat name, logo, original design, software and other materials provided by Niuspat remain the property of Niuspat or its respective licensors, unless otherwise stated.
You may not copy, reproduce, distribute or exploit these materials except as permitted by law or with appropriate permission.
This section does not give Niuspat ownership of content created by users.
11. Availability and changes to the service
We aim to keep Niuspat available, secure and reliable. However, we cannot guarantee uninterrupted service, permanent availability or freedom from technical errors.
We may need to carry out maintenance, address security issues, respond to legal requirements or change features as the service develops.
Where reasonably practicable, we will provide notice of significant planned changes. Nothing in this section removes rights you may have under applicable law.
12. Limitation of liability
Niuspat is provided on an “as available” basis. We do not guarantee that the service will always be uninterrupted, error-free or available in every location or on every device.
To the extent permitted by law, Niuspat is not responsible for indirect or consequential losses arising from your use of the service.
Users are responsible for their own content and for deciding what to record, upload and share. Niuspat cannot guarantee that content shared through an Unlisted link will remain within the intended audience, or that other people will not copy, record or redistribute content they can access.
Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, these Terms do not exclude liability that cannot legally be excluded, or restrict any statutory rights or remedies available to you.
13. Changes to these Terms
We may update these Terms as Niuspat develops, our features change or our legal obligations evolve.
We will publish the updated Terms on the website and change the “Last updated” date. Where a change is material, we will provide notice before it takes effect where appropriate or required by law.
If you do not agree to a material change, you should stop using the affected features and may close your account. Continued use after updated Terms take effect may constitute acceptance where permitted by law.
14. Applicable law
These Terms are subject to the laws applicable to the operation of Niuspat, without depriving consumers of any mandatory legal protections that apply to them.
If you are a consumer, you may have rights to bring proceedings in the courts of the country where you live, where required by applicable law.

16. Acceptance
By creating an account or using features that require acceptance of these Terms, you confirm that you have read and agree to them.
